Terms of Service

Last updated: 28 September 2026

1. Agreement to Terms

By accessing or using AkotoPOS ("the Service"), operated by Akoto Technologies Group Limited, trading as Akoto Group Limited ("we", "us", "our"), a company registered in Kenya, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

AkotoPOS is an online Point of Sale and business management system for shops in Kenya: a till for selling, and an owner dashboard for stock, staff, money and reports. The Service includes the till (pos.akotopos.co.ke), the owner dashboard (app.akotopos.co.ke) and the systems behind them. The till keeps selling without internet and sends those sales when the connection returns.

3. Account Registration

To use AkotoPOS, you must register a business account and provide accurate information including your business name, phone number, and email. You must be at least 18 years old to register.

You are responsible for the staff accounts you create and for what is done under them, and for keeping passwords and PINs private. Sign out of a till before leaving it unattended.

4. Subscription Plans and Payment

AkotoPOS offers the following plans:

  • Duka (free, with no time limit): 100 products, 50 sales a day, 1 staff account, 1 store.
  • Duka+ (KES 750/month): 500 products, unlimited sales, 3 staff accounts, 1 store, loyalty points, SMS daily summary.
  • Biashara (KES 1,500/month): 2,000 products, 10 staff accounts, 3 stores, plus advanced reports (sales by staff and branch, product margins, accounting export), wholesale price lists and selling by crate.
  • Enterprise (KES 5,000/month): unlimited products, staff and stores, white-label receipts and statutory payroll.

Offline selling, M-Pesa, receipts, CSV exports and KRA tax features (VAT reports and eTIMS) are on every plan. The pricing page shows the current plans; we give at least 30 days' notice before a price change affects you.

Paid plans are paid in advance by M-Pesa, monthly or yearly (a year costs the price of 10 months). Nothing is taken from you automatically — each payment is one you approve on your own phone. If a paid period ends without payment, your plan keeps working for 7 more days and then moves to the free Duka plan. Your data is not deleted, but Duka's limits then apply.

5. M-Pesa Integration

Your customers pay straight into your own M-Pesa Till or PayBill. AkotoPOS never holds, receives or moves your money.

  • Without Daraja (most shops): the customer pays your Till and the cashier confirms the M-Pesa message by eye. AkotoPOS records these payments as unconfirmed: it cannot check them with Safaricom, so checking them against your M-Pesa statement is your responsibility. The reconciliation screen is there to help you do it daily.
  • With Daraja: once we have connected your Till or PayBill to Safaricom's Daraja API (you ask from Settings; we connect it and prove it with a KES 1 test), the till can send the payment prompt to the customer's phone and Safaricom confirms each payment.

Card payments are taken on your bank's own card machine. AkotoPOS only records that a card payment happened; it does not process cards. You are responsible for complying with Safaricom's and your bank's terms.

6. KRA eTIMS Compliance

AkotoPOS can send your sales invoices to the Kenya Revenue Authority (KRA) through eTIMS once your business has been set up for it, and produces VAT reports. You remain responsible for the accuracy of your tax information and KRA PIN, for checking that KRA has accepted your invoices, and for your compliance with Kenyan tax law. The accounting export is a summary of your trade for your accountant, not a complete set of books. AkotoPOS is a tool — it does not provide tax or accounting advice.

7. Data Ownership

You own all business data you enter into AkotoPOS, including product information, sales records, and customer data. We do not sell your data to third parties. Products, sales, customers and expenses can be downloaded as CSV from the dashboard at any time, and we will send a full export of your business on request.

Figures such as expected cash, M-Pesa totals and profit are worked out from what you and your staff enter. A product with no buying price, for example, shows no profit. AkotoPOS records what happened; it does not guarantee against mistakes or theft.

8. Acceptable Use

You agree not to:

  • Use AkotoPOS for any illegal activity
  • Attempt to access other businesses' data
  • Reverse-engineer, decompile, or interfere with the Service
  • Use automated tools to scrape or overload the Service
  • Submit false tax information through eTIMS

9. Service Availability

We work to keep AkotoPOS available but do not guarantee uninterrupted service; it may be unavailable for maintenance or faults. The till keeps selling without a connection and sends those sales when it returns. Sales stored on a device that has not yet sent them are lost if that device's browser data is cleared or the device is lost. We are not liable for losses caused by downtime.

10. Limitation of Liability

To the maximum extent permitted by Kenyan law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of AkotoPOS, including but not limited to lost profits, data loss, or business interruption.

11. Termination

We may suspend or close your account if you break these terms. You may close your account at any time by contacting us. After closing, you may request a full data export within 30 days. We keep the records Kenyan law requires (see the Privacy Policy).

12. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved through arbitration in Nairobi, Kenya.

13. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or dashboard notification. Continued use after changes constitutes acceptance.
